UPDATE: OSHA Fines for Tower Collapse that Killed 2 Climbers

Remember the tower collapse on March 25th of this year, 2014? Let me refresh your memory, Tower climbers Martin Powers, 38, and Seth Garner, 25, both died that day. I wrote about it here. May they rest in peace. Both workers fell 250’ that day in near Blaine, Ka. Now, before you go on, take a moment and bow your head, calm down, say a quiet prayer for them before you go on. OK, I feel better? Learn from this and don’t follow the mistakes that were made. OSHA did a good job turning this around from what I can tell. I think I got this right so make sure you look at the links to see the OSHA documentation. Special thanks to Wally Reardon for pointing this out on Facebook!

This shows that there were 2 Citations broken out into several items. That citation is here. What were they for? Well, OSHA dished out fines of:

  • $5,600 for not having the proper markings on or around the gin pole with instructions and load rating. It did not have the proper markings, no labels, no instructions. Not a safe work environment.
  • $5,600 for NOT having a written rigging plan based on scope of proposed demolition (Scope of Work and written plan people!) No written plan for the gin pole. Not a safe work environment.
  • $5,600 for failing to do an engineering survey prior to the work by a competent person, and who was the competent person here? Not a safe work environment.
  • $5,600 for not identifying the load rating of the gin pole for the demolition of the tower. The load chart must be readily available! Not a safe work environment.
  • $56,000 for a willful violation of failing to protect employees by having a wire rope sling attaching the gin pole to the tower without an inspection of the wire rope slings in use… (That is a huge NO-NO). Yes, $56,000.00 fine for doing that. A competent person should have inspected the wire sling prior to use. The slings were defective and should have been removed from service.
  • $56,000 for not having the slings padded from sharp edges.Willful violation!

Do you think they will contest the fines? Probably, most companies do and most companies get it reduced. Usually for claiming the climbers didn’t do their job or they didn’t follow a policy. Sometimes they just ask for a reduction and get it and other times they blame someone else. In all honesty, I don’t know how they will get out of this because people died and it’s not their first offense, so who knows what will happen. I don’t know who was really at fault here, I wasn’t there. All I know is that 2 climbers died, both younger than me, both deserved to live.

OK, before you pass judgment on any of the climbers or the company, I want you to stop thinking that way. We can all sit here and say what we would have done, but the reality is that none of us were there. Many people say they would climb anything for the paycheck and they prove it when one company refuses to climb and the contractor will find someone else to do the job, does this add any doubt to that line of thought? Most of us think we know everything there is to know about the business, I would bet these guys did too. These guys were experienced and seemed to know what to do. Most people think that they don’t need to look at the paperwork to verify the work that needs to be done, well if this doesn’t change your mind I don’t know what will. This is something we can all learn from. The new guidelines that OSHA and the FCC put out should be an eye opener.

So I want you to think about this differently, I want you to learn from this. OSHA laid out some very clear citations. I don’t want you to think about what you would have done but what you will do. If you can look at this and realize that you don’t know the rating of your winch/gin pole or that you don’t have a written plan on site when doing work then start. Take a moment to reflect on your work, on your job, on your crew, on your life. Learn from this and correct your mistakes. Reflect and start to plan better. It may slow you down at first but it will help in the long run. It may not only save your company a fine, but it may save a life. Try to get everyone on the same page.

Do you have the training you need? Are you in over your head? Let me ask you now, point-blank, would you admit it or would you do the job hoping to finish alive? Confidence and arrogance are 2 different things although commonly mistaken for the same thing, they definitely are different.

By the way, I only see the tower crew company getting the fine. Did OSHA look past them to the customer? I don’t’ know. Towers were owned by Union Pacific Railroad, and while I don’t know their safety record railroads usually take every precaution. Did they think that perhaps the people who hired this company to remove the tower did so because they saved money on the missing plan? Did the customer ask about the plan? I would like to see OSHA probe beyond the tower crews and investigate why the customer went with this company. I would like to see if the customer understood the risks and how they did the bidding process. Who was responsible for the demolition plan? These climbers bet their lives that the gin pole would hold! One was on top of it and the other 20 feet below it. Did they know the gin pole loading? Why didn’t they have the engineering plans? Why didn’t they see a structural report of the tower? These climbers were only with the company for 2 months and 5 months, and their equipment was in piss poor shape, why was that?

Before you all pass judgment and think you would have done better, look around at your equipment and inspect it. Learn from this, learn what not to do. Invest is good equipment, rope, safety gear, training, and anything that will make you a better worker, climber, or lifesaver. Do that, or think about a new career. Remember that it is easy to point the finger and say what you would have done but it’s harder to explain why you didn’t do it.

Know your SOW and more Feedback

Hello everybody! First off, if you didn’t see there is a warning sent out about a safety climb. Capital Safety put out a press release that their 3/8” 7X19 strand galvanized cable, also known as “Safety Climb System” could have slippage issues. All the more reason to tie off 100% even when using a safety climb. Read the notice, I have the line here. While not a recall it is a warning so read the document so you understand what is going on. Does anyone remember that not long ago there recently was a snap hooks recall?

Today I am going to discuss the Scope of Work, SOW, for all of you who just go out and do what you’re told. It would be a great idea for everyone who is at the site the review the SOW. I am working on a book that reviews all of the paperwork that the tower worker will be dealing with.

The SOW will have the outline of the job. It should be put together so that you know what duties are required of you. For instance you will need to know what you are installing. You will be putting in just the equipment on the tower or both the base station and the tower. If you are installing microwave, what is your responsibility? Are you doing the installation and the alignment? What are you doing?

Where are you working? This should be part of the SOW as a site list. The site list is a separate document that you will be working with but it should be attached to the SOW as an addendum.

What parts do you need? You should have a Bill of Materials, BOM, as an attachment. This is very important because if you pick up the parts at the warehouse and don’t review the BOM, guess who’s fault it is if you miss something. YOU! YOU! YOU! If you miss a part that is on the BOM and you don’t get it, you messed up. Make sure when you hit the staging warehouse you look at the BOM and check off each part you need. If you are doing the install and you need a part that is not on the BOM, guess what, it’s the customers charge and a change order so you can charge for the labor and part to add it. However, if your people put a clause in the SOW that says you will supply miscellaneous parts, then you need to define miscellaneous parts. Why does this matter, because your customer will consider 200’ of #2 copper as miscellaneous and you may have meant zip ties and vapor seal, that’s why! If you’re asking what the difference is, the maybe you should look for a new line of work. Don’t be an airhead!

So, when I put my package together I will explain the SOW and I will give you an example and I will give you audio to talk about it. I should have something out here in the next 2 weeks or so. I am putting together something for all of the paperwork so everyone can get on the same page and understand what to look for and how to write the SOW. I just need to complete it and I will put it out to you guys.

Now, I have 2 feedback statements I want to share.

Feedback on tower owners:

First off, I have to take back what I said about American Tower not inspecting sites annually. I heard back from one of their people and he told me that at a minimum they inspect the towers annually. He knew the FCC lighting regulations inside and out but he said that with or without light, they make it to every tower at least once a year. That is awesome! Think about it, they have over 28,000 towers in the USA according to http://www.americantower.com/corporateus/investor-relations/. From what I hear they are on top of site inspections. So if something is wrong at the site, maybe you should let them know.

Feedback on Training:

OK, this is great to hear that someone would send their people to IRATA training to improve safety. Here is the statement, “Hi Wade, we got IRATA certified so we could deal with wide face towers safely.  Now we use roped access on many jobs that don’t strictly speaking require it as it’s a safer alternative to relying on fall arrest and once the ropes are rigged often many more times efficient too :)” This is awesome and it’s nice to see some super responsible people out there! This came from the UK by the way, they go the extra mile!

Feedback on TIRAP:

It appears that a professional climber out there is happy that TIRAP is happening. This man is willing to help create the climbers bible, how cool is that. Here is the statement, “Finally! Now we might even be recognized for the skilled work we do under VERY hazardous conditions on a daily basis.  Now, maybe the green guys will understand that 2 yrs. DOESN’T make you a professional yet. But, give it time and actually LEARN from older and more experienced guys. It’s all in the details. I’d like to collaborate with anyone interested in writing a “climbers bible”. Let me tell you something, when you climb for 10 years you begin to learn something. However, you need to keep a good positive attitude. Here is someone who I am going to reach out to so we can collaborate on putting more information out there.

Just to be fair, I did get plenty of negative feedback saying that the industry does not need to follow TIRAP nor do they need to issue this directive. I am surprised by how many people think this is a bad idea. Someone reminded me that this is a recommendation and it is not a requirement. I look at this as a step in the right direction. I am shocked that so many people see this as a bad thing, what a shame. The industry cries for change and improvement and now that it is being recognized and improved it seems people are angry about change. I get it, there are many good tower crews, safe and without incident, but for every 10 safe crews there’s probably at least one crew that just won’t follow the safety practiced recommended just because it costs too much. OSHA just caught someone who didn’t follow the safe climb rules, Morlan Enterprises got a $52K fine on July of 2014. Go ahead and take chances and see if OSHA cares or if the whistle-blower rules matter. Whistle blower fact sheet here! OSHA is your friend, the FCC is your friend, and they are here to help. While we may not always agree with them, in the end they are really here to make our lives safer and better.

Report the Unsafe Towers in a Public Database

OK, here is your chance to send a legitimate complaint out to the world for all to see! This is where the you, the tower technician, the tower climber, the field engineer, the tower worker can exert your knowledge, show some muscle, and become powerful. A database for unsafe towers where you, the person working there, can input your data, thoughts, and facts. Where you ask? Well, I was talking to Vern Fitzgerel, who I met on Facebook, and he put together a form you can fill out by going to http://form.jotform.us/form/42525754737159, This is a form that is asking for details for unsafe towers that you may or may not have refused to climb.Just because you climbed it doesn’t mean it’s safe! This is going to go into a database for unsafe towers that Vern is creating and he will put out on the internet for all to see.. So, this is where the climber, the tower climber, the tower crew, the tower foreman, the lead man, the chief, the project manager, the person who refuses to work on a tower because in their opinion it is deemed “Not Safe”. He will also accept emails at unsafetowers@gmail.com but you need to put more information in the email than to send a picture and say “it’s not safe”. You need details and facts. Make sure if you say it’s overloaded you have some proof, or if you are speculating, explain why you think it’s overloaded based on tower type, loading, and previous experience.

I have seen towers and monopoles that were overloaded based on tower model and load rating and expected ice and wind rating in that region. However, it was all speculation. I have also see towers come down in ice storm that I thought were plenty strong enough. So it helps to have some facts or an educated guess to explain why you think it’s overloaded.

Here is a way that climbers can identify problem towers for other climber, tower owners, OSHA, lawyers, customers, and anyone who maybe we can learn from the front line, the climbers in the field!

First, let’s review what unsafe is. It would be a tower where you would see a hazard that prevents you from climbing the tower because you deem it as dangerous. It could be anything that is a problem. If you think it is overloaded, then maybe you should make sure by requesting the structural report so you can see what the recommended loading it. To look at a tower and say its overloaded is one thing but to see on the structural that it’s overloaded is another. You make see something that is not attached properly or cross members loose or missing, these are all issues. You may see safety issues or other problems.

Why would Vern do this? Because we need to start documenting towers that are unsafe. Many climbers can refuse to climb a tower but the problem may be that they will find another crew to climb it the next day. Many climbers will climb anything where as other climbers may see problems on the tower.

If you refuse to climb, here is your chance to document the tower and why you won’t climb. This is where you, the climber can report problems towers. This is where you can raise your voice to make tower owners aware of issues. Remember, tower companies that own towers may or may not visit their tower regularly. Things get overlooked and lost and forgotten. Well when Vern’s database gets built we can have a reference to look at.

What do you need to do? You need to provide all the information possible. This of what a site list would have on it. You need to provide the details, coordinates, address, type of tower, owner if you know it, and why it is unsafe. If you say that it is overloaded, prove it by referencing the structural or other documentation. If it is not safe, be specific and say why it is unsafe or where on the tower it has issues. If there is a security issue then explain what you mean by that. Be specific in the issue and the location and the site ID if you have it. This way the tower owner can be notified. Maybe they will correct it or maybe not. Perhaps the next crew will not identify the problem or ignore it.

The database should be enough to let all climbers know that where the problem towers are. It will also be a great way to leave a trail in case there is an injury on that tower and it was identified by someone else earlier.

Vern has a Facebook page which shows the link, FACEBOOK/Unsafe Towers, in case it is easier to go there first.

So what would you do with this database? Will you refer to it from time to time? Do you think the tower owners will be held responsible for tower issues? Do you think that it is time we document tower issues in an organized manner. We need to help out any way we can. I think that when you are in the field you may be able to prevent accidents by sharing information. This is your opportunity. This is your chance to save others from a problem you identified.

Let me know, do you think this is a good idea? Do you think you will participate? Let me know. Maybe you just don’t care. Maybe you will climb anything. Maybe you think that if you don’t do it someone else will. Chances are you are correct. Once again, the industry just can’t stand together. Don’t you think it’s time that the climbers start to work together to make the industry a better industry? The FCC and the DOL are beginning to recognize the problems and importance of this industry. Why not do your part out to help out other climbers? Don’t you think it’s time we unite? This is a start.

Wouldn’t it be great if OSHA would be able to look at this to see that there are issues with this tower rather than only having to look at the mistakes the climber may have made? So many times all of the liability is put on the climber because they are the target, they are there, and it’s the only thing they can look at. The more we document and share the better off OSHA will be armed. They need help, let’s do our part. They may or may not listen but maybe we can star to use the tools at our disposal to make deployments safer.

It’s something that turf vendors may run you 100 miles to try to get you to climb a tower that is not safe, so you don’t get paid for the travel time and the turf vendor finds another sucker who will climb it. Is that a common problem? They use that all the time where they will just call someone else and you are out the money but maybe the other crew could be getting pulled into a dangerous situation because they need the money. Now you can document it and then the tower should be labeled unsafe until the tower owner makes some modifications to repair the problem.

Let’s All TIRAP! The FCC and DoL Tell Us How!

OK, not the best title but the FCC and DoL have come together to develop standards for “Telecommunications Industry Registered Apprenticeship Program” (TIRAP), for the occupation of Telecommunications Tower Technician.

OK, this is very exciting. The FCC and DoL have decided to outline the requirements for the Telecommunications Tower Apprentice, Level 1. You may ask why this is so interesting to me. Well let me tell you it’s because the DoL is defining the requirements that are going to be put on the tower technician aka the tower climber.

When will they announce this? October 14th, 2014, 1PM in DC, so it’s Eastern Time. WOW! Requirements laid out! Requirements defined along with a public announcement.

When you look at the schedule and training document you will see they require OSHA 10, PPE training, CPR/BBP//First Aid, RF Awareness, Job Site Analysis, and SOW training. They also outline basic rigging and material handling. Does it stop there? But wait, there’s more! Operate hand tools, operate truck s and trailers, and introduction to structures and Appurtenances! Oh yeah, so much to learn! Let me tell you, this may not be cheap so the customer will be expected to pay more, like they would for an electrician, a mason, or any skilled labor. Maybe the executives complain as they still expect the laborer of years past that had no training but would risk their life for that $10/hour that went out to the lowest bidder. Band together climbing companies because those days are over! The requirements are laid out for you to demand more money to hire skilled labor! These guys are entering a new era, an era where they are going to be viewed as skilled talent. Remember those guys? They are the ones that most companies let go so the carriers could build out the systems for less money! I digress, apologies, let me get back to the point!

In the details they have knots listed, imagine that, the bowline and the clove hitch. They have the SOW listed so they actually want you to know and understand what you are supposed to do at that job site! Amazing insight!

Safety training is outlines, OSHA 10, Authorized climber, PPE, CPR, RF Awareness, Job Hazard Analysis, and SOW. All this required so the climber knows what is going on at the site. These are all explained in the documentation. I love it because this is something I have been saying for a while, not because I am right, because it should be expected that the guys out there should be prepared for anything that could happen. Training and practice will make them the best they can be. Don’t think that you can take the training once and that’s all. You need to make sure your people are trained early, trained often, and trained well! Practice makes the training sink in and if an emergency comes up there is no guess-work, just quick and thoughtful planning to save lives! Practice makes the safety training a habit. We all want good habits, not laziness. We all deserve to have the chance to save our workmates, our partners, our friends, our work family!

Technical training outlines the SOW, basic rigging, material handling opes/knots, antenna/line installation, lightning system installation and maintenance, tower structural installation and maintenance, and applicable standard awareness. They don’t stop there, they add test equipment, exothermic welds, basic understanding of regulatory issues, and operate trucks, trailers, and equipment. Bu hold on, there’s more! Operate hand and power tools like the normal power tools like drills and saws but also torches, connector tools, and tools applicable to the SOW. So much to learn. So many climbers already know this but don’t get the credit they deserve for such knowledge. Skilled labor, professionals are in this industry and now they will be recognized for it.

Let me tell you, this is a wonderful thing to be done by the FCC and the DoL. They are changing the landscape of this industry in the USA. We need the help. If you wonder why, then you live under a rock! This move is because so many out there have been falling, so many have been hurt, so many have been careless, and mainly because the industry let it happen! When I say the industry I lay the blame all around. Do you really think that $10 to $15 an hour is a fair wage for someone to make the schedule so someone’s smart phone will be able to download “Angry Birds” and get Facebook updates? Apparently it was the case. It’s the one thing that someone pushing a deployment could control, or so they thought. Then by simply saying, “I told them to be safe and use safety gear” they could wash their hands of it.

How will this affect you, it depends who you are. The climber stands to get more training and eventually get paid more. The tower crew companies stand to bid higher, make more money, but pay for more training and pay to maintain the training. If you are the end customer like a carrier, your prices will go up. That means that you will pay more for the climbers. I know you will complain, but let me ask you, what is a young person’s life worth anyway?

How will it affect the industry? Well, deployments may be delayed, but will they be delayed any longer than the auctions were delayed? Will the installation take longer than site acquisition? Will the installation take longer than the OEM takes trying to work out the bugs? You know, it goes back to what I said, everyone thinks that the climbing crew is the one thing that they can push and push. Well, now they will be pushing back.

I get a little fired up about this, but I have been on both sides. I know what it’s like to push and be pushed. If you push, take time to listen. When you listen you realize that there is a good reason that the crew can’t do the installation. When you listen you solve problems. It’s really a great thing. Schedule can be a bitch, but losing a life is something that people don’t forget. Schedules are something that’s forgotten in the end as long as the company doesn’t go under. Then they blame the costs and schedules. But when someone dies, all that fails to matter, at least to the family of the lost.

So I think this is a great thing and I am hoping the industry changes for the better. Remember that it takes talent and brains to do this job. Just because climbers get high for a living doesn’t mean that they lose sight of what’s important.

Drugs, Morons, and Steel.

I got 3 things to talk about today – drugs, morons, and steel.

Drugs:

Let’s start with drugs, yes drugs. In fact, I will make it simple, let’s talk about marijuana, pot, hemp, or the wacky weed. Whatever you want to call it, pot stays in your system for quite a while. I read this article about POT on Truth on Pot which says that detectable amounts are in the system for up to 12 hours, but could be detectable for up to 27 hours. Why am I telling you this, because if you smoke the night before and then you have a drug test the following day, guess what, you may fail. If there is an accident and they test everyone, then if there is a trial it is no longer about the accident but about the incompetent drug user on the site. In fact the blame may be put on the guy smoking. So we probably will have drug testing for all tower crews in the near future. Apparently, from the feedback I have been getting most people just can’t stop. One big party on the road. More pot articles are here and here or here. Remember that if something bad happens, there will be someone looking to lay blame, who better to blame than the pothead? Drug test should be mandatory after every incident. Random drug tests may become the standard. Get ready for the changes.

If you care about the coworkers on your site, you need to curb your habits! Even if you are on cold medicine, you need to speak up and say something. Anything that could dull your senses or could cause problems should be brought to the chief’s/boss’ attention. If you are the chief, then wake up and let your crew know. Team relies on each other to live. Lives matter, blame is too late.

Wake up pothead, I don’t care what you do on your own time, none of my business, but if a family loses anything because you’re smoking dope then we have real problems. This industry needs professionals!

Morons:

So now we come to the morons section. This is something that most of you don’t want to admit. Hey, I was a moron a few times, what set me apart was that I learned from my mistakes and I asked for help. Isn’t it great that when someone on Facebook has a legitimate question and all the people can do is rip that guy apart for being stupid! I would like to start my own forum so I can kick those guys out. We are all professionals here, grow up. Are you a skilled professional or a laborer? Which is it? There are places for both on the crew – it’s just nice to know where you stand. What can you tell me about the job you are on? I have done both, but if you are just there for the paycheck, remember that lives are on the line. Don’t be a moron!

Steel:

And now the steel section, we need to be safe on the steel. Are we looking at the big picture when it comes to safety on the tower? Do we know how safe the tower is? Did someone look at the structural? Yes, they usually do because it is an obvious hazard that can be easily, although not cheaply, looked at.

What about the tie off points? Did anyone look to see if the tower was safe to climb and if the climber had tie off points? Ever climb a monopole where the pegs are loose? I did. Ever climb a tower where the face is so huge you need to go to the top and climb down another leg to rig in safety lines? Yup, did that too. Did you ever take two people to rig a safety line to cross a face? I did that too. It’s all extra work.

What if the tower has a ladder up the middle then you need to be able to descend to the point you are working at. Usually in something like that there is very little to tie off to for your positioning lanyard much less another point to tie off your safety lanyard. You probably will need to stay attached to the rope but it’s not an ideal situation. Should the tower owner clean that up? Should they make an effort to make the towers or monopoles as safe as possible for the climbers? Yes, absolutely! Are they doing this? You tell me! Tell me in the form below because I think that when there is an accident they are often overlooked. I worked on many towers where there were so few tie off points. It really helps when they are readily available. They can be added but it costs money. Remember this article?

I think the goal should be that if there is an accident at the tower, we can unconditionally look at the guy that’s hurt and see he was at fault! That should be the goal, to clearly identify the fault, equipment failure or stupidity. Now, however, we are still not doing that. We are still guessing at what happened. Isn’t it time we start taking every excuse for an accident away? We all know that people have to work at heights, we all know how to improve some towers, and we all know that no one wants to spend the money to do it. This is one way to eliminate a problem.

We really need to work together. Remember that this is only one hazard. Keeping hydrated on the tower is a simple way to eliminate another hazard. Working as a team will eliminate more hazards. Daily inspections eliminate another hazard. Tailgate meetings and planning, eliminate more hazards. Hazard assessment – make things as safe as possible, as a team. Training will eliminate another hazard. Practice rescue techniques, keep first aid kits and trauma kits handy.

Do or Die! Are you in over your head?

Qualifications, do you think that just because you climb towers you are qualified to do anything on the tower? What does your company bid on? Does your crew install dishes or LTE arrays or broadcast antennas or stack towers or strengthen towers? Do you know if you are qualified to do this work on the tower? Did your boss assign your crew a job that you know you are not qualified to do? Did you read the paperwork before you started? Are you in over your head? Is it do or die? No, it isn’t! Because if you are not prepared to pull that load up the tower then maybe you should say something to whoever is running the show. Either get the right crew with the right tools or get another company in there to do it!

You company should not be bidding on anything with a dollar sign. Like Clint Eastwood said as Harry Callahan in “Magnum Force”, “A man’s got to know his limitations.” It was much cooler when Clint said it, but you get the idea! Do you know your limitations? Did you plan on lifting such a heavy and large load? Do you know the ratings on your ropes, blocks, shackles, straps, and all associate hardware? Do you? Do you know how to mount to the tower? How about what to mount to on the tower? Do you mount to a small cross member for a large load? Can you tag the load out with the people you have? Ask yourself, can I do this with the people I am working with? Answer honestly!

Listen, some companies bid on work because they need the work, not always because they can do the work.Reputation is big in this industry so that is why when something happens they need to correct it immediately. Accidents happen and most people can forgive, but you need to work extra hard to earn forgiveness and avoid a repeat in the future. If you are good at what you do, then the word of mouth should help you out. 

There is a lot of speculation about how prepared a crew was recently and if they should have been doing this work because of an accident. Could it have been prevented or was it a faulty piece of hardware? If you read this then you can probably guess what accident I am talking about. If you don’t know then go here.

So if you are the one bidding on the work you had better know what your crews can handle. Do they fly dishes or cell mounts? Do they erect towers? If so what kind and how big? Do you think you can do it all? Think again. How experienced is the crew that will be doing the work? How confident are they? How smart are they? How smart are you? All questions that should be asked prior to the responding to the offer.

You see, the thing here is if you are wrong, it may not be a bad day but a funeral. It may cost someone more than a damaged reputation! Think about it. That is why I am in favor of not only experience and learning, but understanding your limitations. If you have worked on something similar than you will understand what is involved and the risks! If you are getting into something new, then it would be a good idea to hire someone who knows what they are doing and get the equipment to handle the job. Plan it out. Read the SOW, look at the BOM, understand you equipment’s ratings. Know what you have and what you will be doing by making a plan.

If something goes wrong, OSHA will look at the people doing the work and that company who is doing the work, but I am thinking they should go beyond that, end to end. Tower owners to the end customer so they know all the factors involved. I am pretty sure that someone at OSHA is looking at this rolling their eyes because they are overworked, but I think once they get the system in place then it will benefit everyone. Once the standards and requirements are set then they will roll it out to the industry. For the tower crews it will probably mean more paperwork to qualify everyone and that will mean more costs for the customer because it will not be free. We all know that paperwork means more money. We also know that it may weed out some of the crews that should not be out there in the first place. It may get ugly before it gets pretty again.

Did someone ask how to use a Capstan properly?

Hey, great resource for Capstan winches from GME Supply, and no, I do not get any type of kickback! I just think this is an excellent resource for someone using a capstan. Hey, what about tower light fines? Remember this?

Also, I got a message from Richard Evans that the tower lighting is enforced so harshly because if a helicopter or small plane crash into it then people will die! They will not survive a crash. So that is why the fines for the tower lighting are so severe and they need to notify the FAA immediately. I really didn’t think about the helicopter traffic, so that is something that needs to be taken into consideration when looking at the fines. I should have thought about that and the towers on the mountain tops. They are all factors for the tower lights causing planes and helicopters to be safe.

Fines: OSHA vs. FCC

First off, thank you for all the near miss stories, I appreciate it! Link is here if you missed it. Keep them coming!

Let’s talk fines and how the FCC and OSHA fines compare. I wanted to go over what the FCC and OSHA are up against. They both issue a lot of fines and many of them take research. The FCC covers so many issue as does OSHA. All that we see is our world and the problems we face. We cry for help because we are losing fellow climbers. We are asking OSHA to help and now the FCC has joined our cause. I thought I would show you how many fines and all the work both organizations do. These guys mostly hear us whine and complain, but there are people working hard in the groups that are trying to make a difference. While I don’t agree with all of the fines, I find them all interesting. This may help us understand why they are taking so long to do anything. That is, we understand unless you know someone who died. Then all this seems unimportant because they need to step in to make sure it never happens again. Look at the losses in the tower industry this year and you see that several of the fallen were older. They were in their 30s and 40s. We need to find out what is happening, and we have been asking OSHA to help. Remember that several climbers were injured and stuck on towers and had to be rescued by fireman after waiting for EMS to respond after the 911 call. Our industry needs help.

So I was reading an article, http://www.somdnews.com/article/20140730/NEWS/140739911/1045&source=RSS&template=gazette, where the FCC imposed a $10,400 fine, reduced from $13,000, for tower lights that were out. The FCC fined Washington Gas for a 2010 Frederick Tower light outage. Washington Gas did notify the FAA immediately, but 4 days after the outage. This is the reason for the fine. I don’t know the circumstances but just bare with me so I can make a point.

OSHA fined S & S Tower Company $14,000 for a tower collapse that killed 2 tower climbers causing a second tower collapse that killed a fireman. In this case three people died, and the fine was slightly more. This was the second violation for this company. However, this seemed to be an accident.

Now looking at this I have to wonder if the FCC has more clout in the government or how the fines for 2 penalties that are drastically different can be so close in dollar amount. Does this make sense to anyone? I think that it’s time that the Department of Labor and the FCC collaborate on how the fines are issued. Something appears to be very wrong here.

Listen, fines are tough, and I have never been on a crew that got any, thank GOD, but I do know that they should be fair. These are 2 incidents that warrant fines as the law is written, but it seems that the heavy fine for the light outage seems excessive and the fine for the fatalities seems light. My opinion!

Now, if you look at how OSHA hammered Morlan Enterprises back on February 25th, 2014, when they saw 2 employees climbing without the proper climbing gear, on a monopole surrounded by trees. They hammered them with $35,000 in fines. No previous violations, but this was a willful violation who was the first to violate the rule stating that workers must have effective fall protection. Keep in mind this was a willful violation, they willingly decided to ignore the safety rules set by OSHA!

So to give you an overview of all the fines, OSHA handed out 8,241 fines for Fall Protection violations in 2013 according to this article. Fall violations were #1 in OSHA’s fine list. They do not take it lightly for any industry.

Now for the FCC it is much harder to count and separate the fines. So I went to their headlines screen here and loaded the data into Excel and here is what I saw was around 90 total fines issued in 2014. The FCC fines are very complicated for the most part. They range from fencing violations to Emergency alert violations to fining Intel for importing unapproved smart phones and tablet. By the way, Wal-Mart was fined $120K for wireless mic marketing issues!

So to sum this up, in the wireless communications tower industry we have needs but these departments are overseeing a ton of industries. So because the tower work is small they tend to get overlooked. I think that the 13 deaths last year and the 9 deaths this year have changed that. I also think that the record hiring rate of green climbers is going to change things. We want everyone to be safe and look out for each other. We need these people to be trained properly and to gain experience from experience. The FCC and OSHA are doing what they can with what they got. What about you? Are you doing what you can to train new climbers or do you sit there and say that someone should do something? I wrote this and I am trying to get the word out beyond Facebook, show some support.

So my question to you, the reader (or listener), what do you think is fair? Is this another government oversight where they just issue fines without a thought standard across the industry? Should the FCC work with OSHA to issue fines in the communications industry? What do you think is fair?

Following these fines, I think that it’s time that OSHA niches down to have a specific division that can concentrate specifically on the tower industry. Even if it’s just one guy. Or maybe listen to the complaints that roll in. Could we do that? They dish out many fines, but they only have so many resources, they need a specialist for the tower industry.

  • * We impose a penalty of $15,000 against Jean Richard Salvador for operating an unlicensed FM radio station on the frequency 89.5 MHz in Miami, Florida. Although Mr. Salvador denies operating the unlicensed station in September 2013, he did not dispute that he operated the station in June or July of 2013. *
  • We propose a penalty of $10,000 against Duhamel Broadcasting Enterprises (Duhamel), for failing to ensure that its antenna structure was properly illuminated. Although Duhamel believed that the structure did not require lighting because of its position in a three-tower array, the Federal Aviation Administration (FAA) notified Duhamel officially that lighting was required for the antenna structure. Given that public safety is at risk when antenna structures are not properly illuminated, Duhamel’s failure to light the structure after the FAA notification warrants a significant penalty. In this Notice of Apparent Liability for Forfeiture and Order (NAL), we find that Duhamel, owner of antenna structure number 1042912 in Rapid City, South Dakota (Antenna Structure), apparently willfully and repeatedly violated Section 303(q) of the Communications Act of 1934, as amended (Act), and Sections 17.23 and 17.48(a) of the Commission’s rules (Rules), by failing to exhibit required lighting on the Antenna Structure during nighttime hours and for failure to notify the FAA immediately that the Antenna Structure was not lit. We conclude that Duhamel is apparently liable for forfeiture in the amount of ten thousand dollars ($10,000).
  • We propose a penalty of $25,000 against CMARR, Inc. (CMARR), for apparently willfully interfering with Federal Aviation Administration (FAA) weather radar in San Juan, Puerto Rico, by operating radio transmitters without a license. Given the risk to public safety created by CMARR’s unlicensed operations, and the fact that CMARR had already received a warning for similar violations, these actions warrant a significant penalty.
  • In this Notice of Apparent Liability for Forfeiture (NAL), we find that CMARR, operator of an Unlicensed National Information Infrastructure (U-NII) transmission system in San Juan, Puerto Rico, apparently willfully and repeatedly violated Sections 301 and 333 of the Communications Act of 1934, as amended (Act),[1] by causing interference to the FAA by operating an intentional radiator without a license. We conclude that CMARR is apparently liable for forfeiture in the amount of twenty-five thousand dollars ($25,000).
  • We propose a penalty of $7,000 against Sound Communications, LLC (Sound Communications) for apparently failing to enclose AM Station WENY’s antenna structure in Southport, New York, within an effective locked fence.       Sound Communications admitted to leaving a gate unlocked for several days so that personnel from a tower repair company could gain access to the antenna structure site in order to prepare a bid for a repair project. The unlocked gate was of particular concern to FCC agents because the antenna structure is located in a residential neighborhood.
  • In this Notice of Apparent Liability for Forfeiture (NAL), we find that Sound Communications, licensee of Station WENY and owner of antenna structure number 1053420 (Antenna Structure) in Southport, New York, apparently willfully and repeatedly violated Section 73.49 of the Commission’s rules (Rules),[2] by failing to enclose the antenna structure within an effective locked fence. We conclude that Sound Communications is apparently liable for forfeiture in the amount of seven thousand dollars ($7,000).

OSHA fines for tower companies (OSHA cites many companies but I only see a few violations in the past few months);

  • COOLVILLE, Ohio Two workers were free climbing, or climbing without safety lines, a 195-foot communication tower under construction without adequate fall protection in Coolville. As a result, Morlan Enterprises has been cited for one willful and eight serious safety violations by the U.S. Department of Labor’s Occupational Safety and Health Administration. OSHA has proposed penalties of $52,500.
  • CLARKSBURG, W.Va. – Following the collapse of a Clarksburg communication tower in February 2014 that seriously injured two and claimed the lives of two employees and a volunteer firefighter, S and S Communication Specialists Inc. has been cited for two serious workplace safety violations. The citations issued to the Hulbert, Oklahoma-based Company follow an investigation by the U.S. Department of Labor’s Occupational Safety and Health Administration.

Dehydration alert!

Remember what Art Seely, (the CEO at Safety One International Training and a senior paramedic, http://safetyoneinc.com/) says, “A summer climber needs fluid with electrolytes such as a diluted 50% Gatorade mixture to drink at 10 minute intervals. The only disadvantage to 50% diluted Gatorade is the stomach “sees” the nutrients in the solution and immediately passes the fluid on to the small intestine where the absorption rate is only 1/3 as fast as if the fluid stayed in the stomach. With pure water the fluid stays in the stomach and is more quickly passed to the blood stream. Once in the blood stream the rehydration progresses next to the cells and finally to the interstitial spaces. The point of mentioning that is that even though a climber feels better after rehydrating from serious dehydration he should wait at least 12 hours to resume any significant work. In winter climbs the majority of the fluid loss is through the surface of the lungs which unlike perspiration does not upset electrolyte balance and water is a great substitute to drink before, during and after the climb… In either case once you have a victim on a tower or on the ground the initial attempts at “fluid resuscitation” should always utilize water at close to body temperature. As with all victims they must be able to hold the fluid container and drink from it themselves, do not attempt to pour it into their mouth as vomiting and aspiration resulting in a delayed bacterial pneumonia is a likely result and that can easily be fatal without prompt hospitalization. Once the victim’s symptoms start to improve then if they were in a hot environment you can start with Gatorade at 50% or 100% concentrations.

FCC & DOL Tower Safety Workshop

Let’s talk about the FCC and the DOL tower safety and injury prevention workshop! (OSHA is part of the DOL.) This is a good thing and needs to be looked at! This year, 9 fatalities to date and 13 last year, this is something that really needs to be addressed. The FCC & DOL released the document on August 4th, 2014, and it’s great that they are stepping up. Wireless Estimator has an update at http://www.wirelessestimator.com/breaking_news.cfm if you want to see what Jonathon Adelstein, President and CEO of PCIA says. There is speculation that PCIA is pushing this and I know that they publicly endorse the event.

So what do you think they will discuss? Remember that it is safety and injury prevention, so that will open up many issues. I am hoping they stick to the death prevention first. We really need to prevent as many deaths as we can. That isn’t just going to be saying tie off 100% of the time. It’s going to be about making sure that the climber has something to tie off to on the structure! It’s going to be making sure that installations are thought out to the detail that a climber can make it around or through the structure on the tower.

Let me ask how many of the tower climbers have had to climb off the climbing leg to get around a dish or a mount or over an antenna? How many monopoles did you squeeze through the platform opening just to get to the next level? How many faces did you cross by holding on?

I think now that the communications industry is changing it would be a good time to update the towers. There will be 2G and 3G decommissioning happening soon. The next wave of LTE-A and 5G builds will be starting. This is a good time to see the industry work together to improve the conditions on towers. Pretty soon the entire radio, BBU and RF, will be on the tower in communications. Only fiber and power will be run up the tower. If there is wireless backhaul, then only power will be run up the tower.

Let’s think ahead, not just in wireless technology but also in mechanical and safety technology to make those structures safe so that the climbers can follow safe processes. Let’s make it so that the tailgate meetings include someone saying how much they love climbing this tower because they have an easy time maneuvering and tying off. Would that be a pleasant conversation for a change?

With the RRHs getting heavier and more common the tower will be asked to hold more and more weight in the radio and the steel. Let’s make sure that we plan out the tower modifications carefully! Let’s make sure that the mechanical engineers are ready to make the changes to the towers. It’s a team effort and when they beef up the tower they can also add some tie off points and plan out the climbing paths. Maybe a better way to cross the face.

So let’s make some noise and let the FCC know that it will take more than just OSHA trying to report what happened. Let’s see if the industry can come together to prevent all the threats. Let’s make it safer than ever with careful planning and thought. I don’t want them to just throw another initiative that is lip service; I would like to see real planning and industry buy in! If the money is going to be spent on growth, let’s grow the best way we can!

A Story of RF Radiation Poisoning, Blogcast Podcast.

Hello everybody. I have something special for you today. I have an interview with someone who had RF Radiation poisoning. I wrote a blog a few weeks back that had information in it about the climber that got RF poisoning years ago. His name is Bruce Elle and he was kind enough to let me interview him and broadcast it on my Blog Cast podcast. You can listen to it here or get it on iTunes. It is over an hour so it’s not something that you can fly through.

I did edit out some swear words, the best I could. This is an adult conversation so be aware not to have children around for this. It is over an hour so make time to listen.

Bruce and I have a goal of alerting people of the hazards of RF radiation.We would like make sure you get the point that safety matters. Although we jump around in our conversation we want to drive home that the more you know the more you respect yourself. Respect yourself by looking for ways to keep you healthy, now and in the long run. You have the tools available to ensure that you will be safe barring a major failure, which happens in this business.

We start out by going into Bruce’s background as a climber and the history of the climbing business. Many people think that the way things are now is how it’s always been. Let me tell you it has come a long way. The advances in climbing and safety have been greatly advance through training and education. The thing about climbers is that they hate to change the way they do things. So the key is to show them how it will help them improve their work and be safer. It is hard to slow down a seasoned climber because they want to race up the tower and get the job done. The focus is changing now to make sure that the job is not only done right but safety is the focus.

Focus, this is one thing that we all seem to have a problem with today. When you are going to head up the tower you need to have focus. Someone needs to be looking out for you. That is why I say the crew needs to work together, so that each person is looking for something that they other person may have missed. But, back to the interview.

Bruce talks about how he climbed up the tower that day he got radiated. He was working on the antenna 550 feet up in the air. This was in February and he was sweating while sitting on the antenna. The beacon was on the antenna. For all of you guys that do cellular work may not understand that broadcast antennas were huge and the beacons were on the antenna itself. The antenna would be a huge steel structure made to be mounted on top of a tower. The engineering that went into these was amazing because it would not only radiate but it would need to be a solid steel structure, in this case 50’ high, that you could climb on and it had a beacon on top.

So he was sitting on the antenna was on low power, which in this case was 35,000 watts coming out of the transmitter. This was considered safe at that time, can you believe it? This was considered safe for someone to site on the antenna to change out the beacon. This was considered a normal day at work.

Bruce didn’t have any real pain right away, he just felt really hot for the middle of February. He didn’t feel anything out of the ordinary until he got home that night, then the fever hit. He had to take an ice bath to break the fever. This was the beginning of so many problems that he still deals with today.

Back then he didn’t have RF alert meters, RF suits, or anything like that. Today you have the opportunity to prepare for the unseen hazards of RF radiation by preparing yourself with those tools. Bruce is telling this story so that no other human goes through the pain and suffering he has endured. OK, get it, he is trying to help all of you by sharing his experience. Listen carefully if you want to live a healthy life. Quality of life matters.

Listen to the interview, Bruce lead a climber’s life, not always perfect but he learned on the way. If you are new to this business you will learn a lot about the lifestyle. You can learn from his mistakes and set yourself up for success. Come up with a plan that will work for you. Think about how you can improve your life by reviewing the safety and lifestyle changes that will make you a better person in the long run. Bruce did this to help you all live a better life, he is here to help.
