Wireless Deployment Efficiencies (WDE)

Do you know what efficiencies can be driven from deployments with proper planning? Maybe I am asking the wrong question, let me ask you this, did you ever have a PM (project manager) or foreman call you and beg you to do a job or a task that you didn’t know about at the last-minute? Oh, that sounds familiar, doesn’t it? Schedules and last-minute changes can kill workers physically and mentally. You know what I mean! Why is it that the customer’s emergency becomes your problem? Probably because something got missed or changed at the last-minute. It happens quite often.

We all complain about how screwed up deployments can get, especially when we are on the receiving end of a schedule change or a last-minute install. We also hope to get paid for these emergencies that are caused by someone’s poor planning. So looking at this up front, what can we do to help the situation out? We can look where we can save time and money with WDE.

OK, planning is very important and most of the time the poor planning is pinned on the contractor when in reality the PM or the customer just missed something or didn’t listen to the people who do deployments all the time. Sometimes the customer pivots to get something done that they didn’t foresee. Other times permitting frees up in one market unexpectedly.

If you pointed something out prior to the deployment, then get over it. Just remember that when you say “I told you so” that it won’t accomplish much except to anger someone. So instead of saying that, why don’t you offer a suggestion on how to improve the situation? You should already know what to do. Make it a discussion, not an argument.

So what do you do? You work with your experience and make sure that your SOW (Scope of Work) has the information in it to make sure you get paid! Make sure that you are a partner in the deployment planning. Have a talk with the PM or customer to figure out the best way to deploy without breaking the budget.

Most of the time this starts up front, with the site surveys. If the survey is done properly and the planning is realistic, then many problems should be avoided. However, what other kinks can happen, like permitting delays, changes to the design post survey, and other factors can ruin efficiency.

If you can, try to make the best out of planning ahead of time. When you are bidding on a job or when you are working on the SOW, make sure you are already thinking of how to improve time to market (TTM) and control costs. What efficiencies can be found? Well, I have notice that in many deployments I have done and planned that there are savings in the following.

  • If the site survey is done properly and documented well then the installers will have no effort in deployment. This will include not only the installation information but building the proper Bill of Materials (BOM). Documentation really helps. Pictures that can be shared with the installers and equipment vendors can really help out the planning process. Many companies put their most experienced people on the estimating and surveys because they want it done right to avoid problems later.
  • If the same company doing the installation does the survey, then the transition usually goes much smoother for the actual deployment and BOM building. However, if something is missing then the installers will need to be sure that they can make up the missing parts. There is no excuse when the same company does the survey and then the installation and something is missing, unless there is a change at the last-minute. Also, the deployment team should let the estimator know if they missed something. Feedback is very important.
  • If the PM plans out the permitting the best they can then the installers should be able to move in an orderly fashion. That is hard to do but it may get better if the permitting process improves. Permitting can be a real problem because of the complexity of the process so the PM will need to keep everyone updated on the status.
  • Warehousing and staging is very important, make sure that the logistics team is aware of the schedule and works with the customer and the installer to provide constant updates. The warehouse will work with the team to provide updates on what has been delivered and staged. Include the installer on those updates to make sure that they are in the loop.
  • If the installers and the commissioning team are “connected at the hip”. They need to be talking and working together to schedule properly. It used to be that many PMs did not like different teams talking because they were afraid they would plan around them. Let me tell you, nothing is farther from the truth. When the installers and commissioners work together they become more efficient and deployments move faster than ever.
  • Deployment planning needs to be shared with the team. If the PM has a priority list then they should make sure that the installer and the warehouse is on the same page. Then let them know that they can move on the top 10 as soon as the site is staged. This is a way to let the installers know that they can move as soon as the staging is completed.
  • Batch sites by region, this is probably the one thing that can really save costs but the hardest to do. I have mentioned it before that if you can do all the sites in one region or city, then you save so much money on travel. It doesn’t always work, mostly due to permitting and leasing and customer expectations. I have been on projects where the customer wants to see progress and they order the installer to do one site in a region because they want to show the customer/investors that they are making progress in a hot area. They argue that they want you to install for the bulk price even though the installer costs increase when going to one area to do a single install if they are not local. Chances are you will do it to keep the customer happy but this really eats into margin causing you to raise the prices next time because the customer requests irrational planning not thinking of how the cost rolls downhill.
  • Understand what they big picture is. Sometimes the deployment team will get caught up in the deployment of their priority sites because they don’t think about the system. Sometimes the deployment of the sites may be ahead of either the core/controllers or licensing is ready for the turn-up. So the sites may be deployed and sit for months until brought live. Then when they are brought live problems show up. I have been through many deployments like this. It causes so many problems but this is how many deployments happen. Sometimes the customer will expect you to come back to repair something months after the installation, understand what the agreement is ahead of time, read the SOW and the contract so you can plan accordingly. Customer relationships need to be thought of as well, remember that if you piss of the customer you may lose the customer.
  • Have the right tools for the job. Remember to plan out the deployment. If you need a bucket truck then get a bucket truck, put it in the pricing and use it! You may need a crane or a welder or more manpower. Plan accordingly.
  • Plan out the overnight stays ahead of the deployment. You can save money sometimes if you are going to be in an area for over a month by finding an apartment or negotiating with a local hotel for the full month. If you can plan and work on hotel costs, it saves money.
  • Learn what you’re installing! This is something where you will need proper training on the equipment. Whether its beefing up a tower or installing several RRHs. Sometimes you will be deploying something new, but if this is something that has been GA’ed, (General Acceptance) then it should have a MOP (Method of Process) put out by the OEM. Remember not to confuse the OEM’s MOP with the customer’s MOP. They are usually very different. The OEM will cover the OEM equipment only but the customer’s MOP should cover all of the site equipment. If you know the proper process then it will cut down on the return visits for the punch list. Return visits cost money and time and delay payments. Make sure you do as much right the first time as possible and have the MOP to back it up.
  • Plan to be on site when the inspection takes place. This is really hard when you have limited people. I used to have a crew or person that would be on site when the inspection took place so that all the issues could be resolved in one inspection. This would speed payment and closure. The PM should be able to schedule this but they need to be aware of how much time this will save. One of the biggest reasons time and money is lost is because the customer and the contractor go back and forth trying to closeout a site. It can go on for weeks or even months. It is very frustrating and can be prevented by some simple planning.
  • Site prep is very important. If this is a new deployment, for macro or small cells, power needs to be ready. Leasing needs to be completed. Permitting needs to be completed. If you go to install something and something is not ready, it is a major problem. So if you are the PM, make sure everything is complete to prevent the second visit. Verify as much as possible.

I put a few things in here that may help you out. Most of this is obvious, but it seems that there are still problems with what I have laid out, no deployment is perfect. I see all of these problems arise again and again. Problems always arise, there are always delays due to outside issues, like weather or if the customer makes a change or if the contractor will not get paid. We always see problems that can’t be counted for. It happens.

I understand from many of you that you are working as contractors and need to write or update a SOW. My intention is to make sure that you understand the work in the SOW and that you understand how to protect yourself from doing work that is not covered in the SOW. I tried to make it clear how this is going to be your key to getting paid for the work you do and how you can create a change order for the work that is not in the SOW. Remember that all the extra work you do will cost your company money so you will need to weigh out whether the customer is going to appreciate it and reward you with more work or if they are taking advantage of you. That is your call but if the SOW is properly written you can make it your decision how to process.

Comment OSHA 1910.151(b) in the absence of an infirmary, clinic, or hospital in near proximity to the workplace which is used for the treatment of all injured employees, a person or persons shall be adequately trained to render first aid. Adequate first aid supplies shall be readily available. Seemingly this indicates the necessity of a minimum of two persons.
Also, OSHA 1910.38 Emergency action plans. The requirements for a rescue plan under OSHA 1910.38 require a written rescue plan is on site completed and signed by all participating personnel.
To my knowledge, I have never reviewed a plan of rescue that
could be construed with a single climber carrying out the complete written activities to be performed during execution of a rescue.
One last thought, I do not believe there is a legal allowance affording the presence of only a single employee on site at any given time. This/these are my interpretation of the readings of the above stated reg.’s. Be familiar with the rules and when and where they may apply. Help with your crew members to become familiar, and at the same time become able to Trust yourself to know. That’s all I have,

I hear about this frequently. Not too long ago one of our clients told me about how he fired someone for climbing alone after repeated warnings. Nice to see someone stand behind his words with actions.

Response: Thank you for taking the time to let everyone know the dangers of climbing alone. Even if you think you can, it is better to have someone there. I know the mentality that it won’t happen to you. We all think that until something so stupid happens, then we know it could happen to anybody. Things happen, good and bad, not always in our control or we get careless. Not fair, but it does. We aren’t always smart, safe, and we don’t always pay attention. We say we do, but we get stupid when we are in a hurry or tired. I know I do!
Comment: Well I do understand where this is coming from. I remember when our policy was buddy system we were to NEVER climb alone. Then as the company got busier it was well its okay just call me before, at location, and back on the ground. Then it went to no mention the fact I was aligning a 6′ or 10′ antenna by myself at 500’….. As time went on the company got so adapted to us climbing alone that if I said someone should be with me , it turned into well I guess we didn’t have what it took to step up. I made my way from greenhorn to lead man to supervisor, to job coordinator. After 15 years I decided to leave. There comes a point when a man becomes a man (at times a stupid one) but we all do what we have to do to take care and provide for the time being. Once he or she realizes the company that sends them out alone is only worried about their Upper Management Bonus check that comes in when the job was done with less payroll. PROFIT is all it comes down to. So if you’re reading this and you understand what I mean. Stop living (risking) your own life for your company that doesn’t care about your worth as an employee. I’m no longer there and left the industry entirely. Now I only kick myself for not doing these 14 years and 11 months ago. When your employer values and respects you……. You as an employee will have a new-found fire and self-worth to exceed farther than you would if you were left alone with no help if needed. Be safe guys and WHOOP! WHOOP! Climb safe and take your time to double-check your anchor. And remember its okay to be 100% tied off it’s a good habit & gets you home safe. Take care.
Response: Thank you for the honesty! I know exactly what you mean. We usually start out with the best intentions, but then something changes, the workload, the schedule, the bonuses, the money, or we just get lazy. We may deny all of these, but I have been there and I have the advantage of 20/20 hindsight, and I know that I fell into these categories. Denial is something we can do until something terrible happens, then all we have is our excuses.
Comment: At the end of the day it all comes down to safety training. But people still make mistakes… most of which I’d say is caused by fatigue caused by poor management, busy work schedules, pressure to finish sites quickly, etc. Wireless work is very complex and it takes very knowledgeable people to make it work.

Are Work Schedules Killing the Wireless Field Worker? YES!

Hey, I read an article from Jon Gelman (found here) about workers schedules. If you have the time I seriously recommend reading the article. It explains how so often schedules are completely out of control of the workers. When I read this headline I thought, finally, someone cares about the wireless field worker! However, this bill targets retail, food service, and cleaning industries, people who get to work close to home. (Once again the wireless field worker is ignored!) These industries apparently have rough schedules. This is a bill being proposed here in the states by Iowa Democrat Senator Tom Harkin that is going to change that. I don’t know this senator at all, or anything he has done, but I would like to see a bill like this one, found here, for the wireless field worker. Why? Because it focuses on how the workers lives that are greatly affected by their work schedules. This is because businesses often put the job first and families second. You see this when companies put the profits first by laying people off and working the people they have three times as hard to save the company, profits first. This bill is supposed to help people with their families and with continuing education. So let’s talk about why they are doing this, first off it has come to the attention of the government that the workers families can be devastated by these grueling schedules. People just can’t maintain a healthy family life nor can they continue to educate themselves. This will provide the workers with a schedule 2 weeks in advance and provide them with extra pay if they are sent home early without pay. Sound familiar?

OK, here is where I vent, my opinions below.

Hey Senator Tom Harkin, ever work in wireless? I wonder, does anyone on Capitol Hill understand the wireless worker’s schedule? Schedules in wireless deployments are grueling and painful. When will this be magnified? Workers deserve fair schedules, right? Is it too much to ask to place some sanity in deployments? Did any politician ever work in wireless deployment? I don’t mean as an executive or as a CEO, but doing the field work? The only thing that is fair is……well, for the field worker not much. I mean you have all those perks like low pay, tough schedules, dangerous work, and hoping to get paid. With all of that on your side, why worry? Many wireless deployment companies work their people hard – physically and emotionally – by sending workers all over the country only to let them go the minute the work seems to be drying up. You get to see your family every other weekend and when you get laid off. I really don’t see that as fair. That is why so many of these guys are on the edge, irritable, and ready to explode. Don’t get me wrong, some people like the lifestyle, I would say about 10% in my guesstimate. Many people love climbing, it becomes a passion with many people. I don’t mean just for the thrill but for the combination of the work and product.So much passion can be ruined by these schedules and poor companies. However, if you work for a standup company, good business people, then you will really fall in love with the job and the business.

Schedules, family life, and pressure were the themes at the TIRAP conference, information found here and here. I think it’s amazing how long it is taking to get word to the US government beyond the DOL and FCC! How do we get the word to politicians? They seem to listen to carriers about the woes of the spectrum auctions.

The worker will need to find a way to get the word to the people who make the laws if they want to find a cure for this. Many wireless field workers deal with insane schedules, crazy jobs, remote locations, health hazards, corrupt employers, and mental health abuse. All this and then they find out that their per Diem has been cut or their paycheck is late or that when they return they are laid off. WOW! What a career move. Don’t forget that if there is an accident and the job is not complete they may not get paid! If they do have an accident, then they will be surrounded by lawyers who may want to blame them. All this and they have injuries that they will live with for the rest of their lives. Like they wanted to live this way for the rest of their live!

It is the old adage, if a climber gets laid off, does the customer care? Apparently not, but when the carrier lays off people it makes major news. Think about it. Did you read about Sprint lately? The funny thing is when they have a lay off people the stock value usually goes up, rewarding the stock holders for letting people go. I get it – the company is saving money by letting people go. There could be many reasons – the market changes, the management team planned poorly or could not grow the company or changing direction so now it’s time to make drastic changes. Everyone appreciates the downsizing, except the people who got laid off collecting unemployment. It really sucks for them. They need to find work in an industry that is tough to work in. They hit the streets to compete with their former co-workers for a new job.

I recently talked to someone who left the industry for different work, this was awhile ago but I remember he said in his email to me that “My worst day in this job is better than my best day as a climber.” He understood how hard the industry is to work in when the very people you are helping do everything they can to devalue your livelihood. He may be reading this so he knows who he is. If he reads this I am sure he will comment.

So, it’s great that the retail, food service, and cleaning industries have an advocate in government working for them. Who is the wireless worker’s advocate? Please, fill me in. I look to the FCC and the DOL, (OSHA), as our friends  and allies looking out for us in Washington. Maybe we need a senator or a congressman who wants the madness to end. Who is it? Please tell me! Who will help the wireless field worker?

Loyalty versus Lowest Bidder in Wireless

I was reading a book where they mentioned how purchasing is done differently among companies and people. We all want a good price for what we get, right? Well, is the lowest price always the best? Sometimes it’s good enough. What about when getting high-end work done? Is it lowest bidder good enough for a wireless deployment? That is how most of the business is done. Except maybe among broadcast where they usually only put out the bid to people or companies they really trust. They know who is good and who is not, at least they used to. They usually build loyalty into the offer.

Today’s world revolves around investors, who really have very little loyalty beyond the bottom line. I see it often where a contractor may have a horrible reputation but continues to get work because they are very cheap. It takes awhile before they are found out to be cutting corners or not paying people.

Many companies have lists of contractors that they know are not good, or don’t meet their standards. They also keep lists of acceptable vendors that were pre-qualified. The idea is that they have at least showed their qualifications on paper before getting the work. Then they need to win some jobs and get the work. If they do good work then they can be rated or graded on the work they have done. This is a normal system.

However, what happens when a company gets caught doing shoddy work? It seems some people change company names and they are back in the game. How can we stop this? We will have to do the due diligence by researching the bad seeds. This is why there are some people who are blacklisted in the industry. We just need to make sure that the blacklisting is justified. This is where loyalty and reputation come into play.

So loyalty between a sub and a company is earned, not given. Once you meet the minimum requirements you must do the work and do it well. If a company puts a contractor on the short list, it should be for good reason, either that company does great work or a particular crew really impressed the customer. That often is the case, where there is the “A” team that can really impress. We can’t all be on the A team but if you work harder to care for the customer’s needs then you will make a positive impression. Customers need to have someone they trust to do good work and be honest with them. Is that you?

Now, what about that crew that stinks? You know who I mean, the ones that run out of hardware so they use tie wraps to finish securing the mount because it’s Friday and they don’t want to do a return trip. Maybe you didn’t see the crew that did it but you saw the work. How does that not make it into the close out package? Do you report that to the tower owner? That is one more thing we need.

It’s hard to bring you’re “A” game when the customer might not pay you or if you are working for a customer that may be on thin ice. Sometimes the contractor does not pay its subs. This causes so many problems in the industry. If the customer hires someone they trust then they know the payment terms. If the sub is working for someone new or someone who is a piss poor manager, then payment will be late or not happen at all. The end customer suffers, the sub suffers, and people spend the rest of the time pointing fingers. That is going to destroy trust. If the PM purposely screws a crew by not paying the workers for getting the job 80% done then bringing in a cheaper crew to finish it just to pay the last crew a lot less money. That is just shameful. This is another issue with trust among workers in the industry. Loyalty and trust is a 2 way street not only to be earned by the hard-working crews but by the customer who is supposed to pay them and treat them fair!

Again, trust is earned and it’s a 2 way street. Remember that there are project managers that take pride in cheating hard-working crews because they think they are saving money but it really hurts the industry. When will this stop? Let’s hope today, but let’s face it, there will always be snakes in the industry, or any industry for all that matters. We need to get names of these people so we know who to trust. Names should be on a loyalty list of naughty and nice people to work with.

This industry is small, what comes around goes around like Karma on here we need to play well with everyone. Just because you compete against someone doesn’t mean they are the enemy. You may have to work together on a future job or you may team up one day. So treat your fellow workers with respect and learn from them and teach them something. We all need to learn to work together. Loyalty in the industry among coworkers is just as important as loyalty between customer and contractor.

Loyalty needs to be earned and it is hard to gain back once it’s lost. So many times there are people associated with bad companies. All you can do is work hard to regain trust and respect. It is not easy but it can be done. We all need to learn from our mistakes. The lowest bidder and the layers of subs really can cause problems in any industry. So let’s be fair when we bid and let’s understand the scope of work so we can all be fair to the workers as to not get in over our heads!

So let me ask you something, if you needed brain surgery or a heart transplant, would you put it out to the lowest bidder? Maybe it would be nice to have someone with a good reputation, a name that you can trust, someone who you got to know and someone you can trust. It should be the same in the wireless deployment industry. After all, if they could do the work themselves they would, but they don’t because it is a specialty.

The wireless deployments are not going to end anytime soon. It is time to build loyalty among the players in this industry. Let’s build a wireless industry based on trust. We need good leadership to do that. It is something that will be earned over time. Let’s each start with ourselves, let’s do the best we can for our own sake to make this the best industry to work in. In the wireless deployment industry we are looking at NATE, CTIA, FCC, OSHA, DOL, and each other for leadership. We now have TIRAP. They are the groups working to make sure that there are examples of safety and workmanship. It is up to each person out there working to align with the leadership and become a leader in their company. To become the poster child for quality and safety for fellow workers to follow should be the goal. Just because I say align doesn’t mean we should follow blindly, we all need to point out faults when we see them. Here is your chance to set the example of being the best worker you can be in safety and quality. With enough people working hard to be the example them more people will want to align and follow only to become the future leaders.

I heard about this firsthand when someone came looking for information. Wireless Estimator wrote about it here. What happened was someone called several people stating that a climber fell and died. This type of thing worries so many people. We have enough problems in this industry without people making up stories about death. I don’t know the whole story, but I will tell you that someone thought it would be funny to make up a story that a climber had died. To call people and then put it on Facebook that a fellow climber, a towerdog, a brother in climbing, had fallen. This happened about 2 weeks ago.

OK, to start with I think that people out there need to understand that many people really care about the industry, so when someone says something like this because they think it’s funny, they cause sleepless nights. They cause OSHA and climbing groups to research the facts. They waste a lot of time of many people because of some sick joke, a sick prank. I get calls all the time of past and present problems, some true and some made up. I research issues and I understand that there are so many angry people in this industry that want to make it look worse that it already does. With so many people working around the clock to make this industry a better place, it’s a shame that there are a few people giving it a bad name.

If you know one of these people, deal with them accordingly. They really are not an asset to the industry nor to anything in the wireless profession. They are a disappointment to not only to the wireless industry, but to themselves as well. I like to think that we can all learn from this. Unfortunately, next time something terrible happens we will need to say, prove it because of people like this.

All I can do is complain about and, forget about it, then move on and be thankful that the FCC and DOL are working together to understand the industry and make the workplace safer than it has ever been in the USA.

For the person that started this rumor, congratulations, you made some people worry and feel like crap because they genuinely care about other people and the industry. As you sit at home this weekend and laugh at the pain you caused, at the company you slandered, and at the profession you maligned you can be proud that you were able to sink to a new low by setting the standard for decency even lower.

For everyone else – Do me a favor, don’t be despicable, be decent and make the world a better place by helping each other out. Helping each other takes time and effort but it’s worth it. There are so many good people in this industry. So many people who do good things for as many other people as they can reach. I am thankful for that. I worked and talked to many of those people. So let’s work together to make this a better work place. We all make mistakes, so let’s forgive, get over it, and push forward.

In my opinion, the wireless industry is a great work place. I get frustrated at times and like any business you have scum buckets. Then you meet people who really care and want to make their work shine, people that really care about each other, then I have hope that wireless is the best industry to work in ever.

I got quite a bit of feedback on the post, “My Company won’t Pay Me, Now What?” so here is some of it.

Comment: The only comment I have is to NEVER spend your own money for supplies.  You are a naive sucker if you do.  Plus, it will save you all the trouble of doing what this gentleman had to do.  These companies for the most part will take advantage of you if you give them the opportunity. If they want a project finished badly enough, they will get the supplies to you.

My response: Good advice to follow, I learned the hard way, much of that depends on who you work for.

Comment: I’m very happy that you ultimately got paid – sorry that you had to spend even five minutes fighting for what was yours to begin with.
I complain on one axiom you mentioned:
“they thought they would get away with because this company did business by not paying unless they absolutely had to … “
This should have been worked out unambiguously, immediately before signing on as an employee or contractor.  I’m not chastising you – I’ve been burnt before – became wiser afterwards, immediately. I got burned once – never again. I recouped my stolen loot – and will die with the secret as to how I did it. I surely wish all of you who trust people [companies] – only because you’re trustworthy yourselves, will learn as quickly that snake oil people are embedded even in Fortune 500 Companies.

My response: It actually was worked out in my work contract, that is why I got paid, and thank you for understanding. You are correct, I am wiser now and I pay attention to how the company does business, that matters. I research a company and the people who are in management before I work there. I worked for a company that didn’t get paid and they went to court and won, yay, however they still didn’t get paid. Just because you have it in writing doesn’t mean they will pay you, it only means you won and that you may have to go back to court again. I have seen some companies spend more time working not to pay people than working to make a profit.

The industry is full of bad moral.
I have worked as self-employed in Denmark for many years.
At several occasions the customer will not pay.
It is much too easy. They can do it with no risk.
The customer get a free credit and probably a discount, due to a compromise. I have always made a legal case against these companies.
The law should be changed in a way, so that the companies risk a penalty if they don’t pay what they owe you!

My Company Won’t Pay Me! Now What?

OK, so your company didn’t pay you a salary or they didn’t pay you your expense money, what do you do? I know what I did! This is if you were an employee.

Update: By the way, if you didn’t see Wireless Horizons is going to protest the citation! In an article by Tom Raum in the Southeast Missourian, found here, you will see that Rick Heisler, president of Wireless Horizon, states that he respectfully disagrees with OSHA and will vigorously contest them. So here’s what happened. I worked for a company as an employee that racked up the expense money, they put off payment with lame excuses and I was stuck. Many people wonder how you let something go for to several thousands of dollars. I will tell you that when you are working a job or for a company your primary goal is to finish and keep going. It doesn’t take long before you are in the hole for a lot of money. Simple expense money is not cheap and it adds up over time. When you are booking a hotel and then adding meals it doesn’t seem like much. Then when you buy hardware for a job because you have people on site who want to go home, it makes sense to get it ASAP and think about the cost later. Before you know it you have thousands of dollars gone. This is one thing that most customers like to ignore. It’s funny when they limit the expenses of their own employees that may travel twice a year, meanwhile you are living on the road, but that is another story. 

Then they laid me off, owing me thousands of dollars in expense money. I think that they thought they would get away with because this company did business by not paying unless they absolutely had to. This was not different in their eyes.

Here is what I did, I called a lawyer. He gave me great advice, for free, he told me not to use a lawyer because it would cost me money and would eat into what they owed me, it could be more than they owe me. He told me to go to the department of labor for that state. So remember, that when working the legal system that many times it is more about money than justice. He told me to go to the state department of labor and file in claims. I did this. It was a learning process and one that took time. I had all of my information, the agreement, the list of expenses, the amount owed me and so on. Make sure you include any interested owed to you and estimate about another 3 months in there because it will take about that long to get it resolved. Always keep the paperwork with the agreements or the employee handbook. This is specifically for employees. I will do another post for contractors. 

Remember to make sure you get the agreement (or employee handbook) in writing or print because you will need to prove that they owe you the money. Getting things in writing, even email, is huge! Make sure you not only have it in writing but you keep it somewhere safe. In other words, the company’s computer isn’t the best place! Keep it on a thumb drive, on a personal computer, or print it out. You may have to testify that you spent the money for that company, so review everything and make sure that you know what the equipment was for. Make notes. Put them in an organized fashion when going to court and preparing everything. 

So what I went to the department of labor in that state and filed a claim. They had the process online. Now, this took some time to do it right! I made up a spreadsheet of everything they owed me and put the receipts or a copy of the receipts together in one package. I also had the credit card bills that I used to build the spreadsheet. I put it all together. I also took the expense reports I filled out and added them as well. I also had a copy of the work contract. All of this impressed the judge. I am not sure if he was a judge or a councilman but I called him “your honor” all the same. 

I had to drive 3 hours to go to the hearing, again, a day off work at my new company, but they understood. I went to the hearing after the other party delayed the hearing 3 times, the maximum allowed and always at the last-minute! so when hearing day came, they didn’t even show up. I won favor with the judge and then he told me they still have another 21 days to appeal. This drove me crazy, another 21 days? I fully expected them to delay as long as they could. They had 21 days to appeal and 30 days to pay. I could not believe it! 

So, much to my surprise, they did pay me, on the last day the check arrived in the mail. They did not follow due process, as usual, they just sent  a check. So I had to alert the state department of labor that they paid. The state followed up on the case, they made sure and they wanted to see a copy of the check and wanted to make sure it cleared. They were on top of this and they take employee’s pay very seriously. This is a good thing because some people just give up, but the DOL did not, they wanted to be sure the process was complete.

So listen, the department of labor is the worker’s friend! So is OSHA and the FCC. They are on the workers side. I know that now. I appreciate them. 

So if you don’t get paid, don’t just walk away because you will not only lose your money, but the company will screw as many people as they can. Let’s face it, most people are lazy, they just chalk up the loss and walk away. Depending on how much money it is, I may have to. When it’s enough money, then you need to do something. I am telling you, companies “not paying” are very common in this industry. I will write another article about when companies don’t pay the contractor. This is very common as well. The only thing I can say it make sure that you don’t work for them again! EVER! That is, until they pay you. Then use your better judgment and get ready for small claims court.

So, if you want to this make you have a legitimate complaint! Don’t start something because you thought could expense alcohol, that is going to be a problem if it’s not in the company handbook. Also, you are going to working with the state Department of Labor. Show them respect, don’t be a jerk and understand that you don’t know it all, got it? The judge is the boss, not you, listen to what they say and don’t challenge them unless you have solid grounds to stand on. If you have a temper and you don’t like what you hear, keep it in check. Make sure that you understand that you need to file in the state where the work was done or where the person you are charging resides.  If I don’t have the link you need below then Google the Department of labor + the state you need. It takes time, it takes patience, and you need to think this out. What I mean by that is don’t put everything together half-ass, you know what I mean!

UPDATE: OSHA Fines for Tower Collapse that Killed 2 Climbers

Remember the tower collapse on March 25th of this year, 2014? Let me refresh your memory, Tower climbers Martin Powers, 38, and Seth Garner, 25, both died that day. I wrote about it here. May they rest in peace. Both workers fell 250’ that day in near Blaine, Ka. Now, before you go on, take a moment and bow your head, calm down, say a quiet prayer for them before you go on. OK, I feel better? Learn from this and don’t follow the mistakes that were made. OSHA did a good job turning this around from what I can tell. I think I got this right so make sure you look at the links to see the OSHA documentation. Special thanks to Wally Reardon for pointing this out on Facebook!

This shows that there were 2 Citations broken out into several items. That citation is here. What were they for? Well, OSHA dished out fines of:

  • $5,600 for not having the proper markings on or around the gin pole with instructions and load rating. It did not have the proper markings, no labels, no instructions. Not a safe work environment.
  • $5,600 for NOT having a written rigging plan based on scope of proposed demolition (Scope of Work and written plan people!) No written plan for the gin pole. Not a safe work environment.
  • $5,600 for failing to do an engineering survey prior to the work by a competent person, and who was the competent person here? Not a safe work environment.
  • $5,600 for not identifying the load rating of the gin pole for the demolition of the tower. The load chart must be readily available! Not a safe work environment.
  • $56,000 for a willful violation of failing to protect employees by having a wire rope sling attaching the gin pole to the tower without an inspection of the wire rope slings in use… (That is a huge NO-NO). Yes, $56,000.00 fine for doing that. A competent person should have inspected the wire sling prior to use. The slings were defective and should have been removed from service.
  • $56,000 for not having the slings padded from sharp edges.Willful violation!

Total penalties will be $134,400 for serious and willful violations! OSHA severe violator enforcement program is here. An article covering this by EHS is here. Remember that this company is a repeat offender.

Do you think they will contest the fines? Probably, most companies do and most companies get it reduced. Usually for claiming the climbers didn’t do their job or they didn’t follow a policy. Sometimes they just ask for a reduction and get it and other times they blame someone else. In all honesty, I don’t know how they will get out of this because people died and it’s not their first offense, so who knows what will happen. I don’t know who was really at fault here, I wasn’t there. All I know is that 2 climbers died, both younger than me, both deserved to live.

OK, before you pass judgment on any of the climbers or the company, I want you to stop thinking that way. We can all sit here and say what we would have done, but the reality is that none of us were there. Many people say they would climb anything for the paycheck and they prove it when one company refuses to climb and the contractor will find someone else to do the job, does this add any doubt to that line of thought? Most of us think we know everything there is to know about the business, I would bet these guys did too. These guys were experienced and seemed to know what to do. Most people think that they don’t need to look at the paperwork to verify the work that needs to be done, well if this doesn’t change your mind I don’t know what will. This is something we can all learn from. The new guidelines that OSHA and the FCC put out should be an eye opener.

So I want you to think about this differently, I want you to learn from this. OSHA laid out some very clear citations. I don’t want you to think about what you would have done but what you will do. If you can look at this and realize that you don’t know the rating of your winch/gin pole or that you don’t have a written plan on site when doing work then start. Take a moment to reflect on your work, on your job, on your crew, on your life. Learn from this and correct your mistakes. Reflect and start to plan better. It may slow you down at first but it will help in the long run. It may not only save your company a fine, but it may save a life. Try to get everyone on the same page.

Do you have the training you need? Are you in over your head? Let me ask you now, point-blank, would you admit it or would you do the job hoping to finish alive? Confidence and arrogance are 2 different things although commonly mistaken for the same thing, they definitely are different.

By the way, I only see the tower crew company getting the fine. Did OSHA look past them to the customer? I don’t’ know. Towers were owned by Union Pacific Railroad, and while I don’t know their safety record railroads usually take every precaution. Did they think that perhaps the people who hired this company to remove the tower did so because they saved money on the missing plan? Did the customer ask about the plan? I would like to see OSHA probe beyond the tower crews and investigate why the customer went with this company. I would like to see if the customer understood the risks and how they did the bidding process. Who was responsible for the demolition plan? These climbers bet their lives that the gin pole would hold! One was on top of it and the other 20 feet below it. Did they know the gin pole loading? Why didn’t they have the engineering plans? Why didn’t they see a structural report of the tower? These climbers were only with the company for 2 months and 5 months, and their equipment was in piss poor shape, why was that?

Before you all pass judgment and think you would have done better, look around at your equipment and inspect it. Learn from this, learn what not to do. Invest is good equipment, rope, safety gear, training, and anything that will make you a better worker, climber, or lifesaver. Do that, or think about a new career. Remember that it is easy to point the finger and say what you would have done but it’s harder to explain why you didn’t do it.

Report the Unsafe Towers in a Public Database

OK, here is your chance to send a legitimate complaint out to the world for all to see! This is where the you, the tower technician, the tower climber, the field engineer, the tower worker can exert your knowledge, show some muscle, and become powerful. A database for unsafe towers where you, the person working there, can input your data, thoughts, and facts. Where you ask? Well, I was talking to Vern Fitzgerel, who I met on Facebook, and he put together a form you can fill out by going to http://form.jotform.us/form/42525754737159, This is a form that is asking for details for unsafe towers that you may or may not have refused to climb.Just because you climbed it doesn’t mean it’s safe! This is going to go into a database for unsafe towers that Vern is creating and he will put out on the internet for all to see.. So, this is where the climber, the tower climber, the tower crew, the tower foreman, the lead man, the chief, the project manager, the person who refuses to work on a tower because in their opinion it is deemed “Not Safe”. He will also accept emails at unsafetowers@gmail.com but you need to put more information in the email than to send a picture and say “it’s not safe”. You need details and facts. Make sure if you say it’s overloaded you have some proof, or if you are speculating, explain why you think it’s overloaded based on tower type, loading, and previous experience.

I have seen towers and monopoles that were overloaded based on tower model and load rating and expected ice and wind rating in that region. However, it was all speculation. I have also see towers come down in ice storm that I thought were plenty strong enough. So it helps to have some facts or an educated guess to explain why you think it’s overloaded.

Here is a way that climbers can identify problem towers for other climber, tower owners, OSHA, lawyers, customers, and anyone who maybe we can learn from the front line, the climbers in the field!

First, let’s review what unsafe is. It would be a tower where you would see a hazard that prevents you from climbing the tower because you deem it as dangerous. It could be anything that is a problem. If you think it is overloaded, then maybe you should make sure by requesting the structural report so you can see what the recommended loading it. To look at a tower and say its overloaded is one thing but to see on the structural that it’s overloaded is another. You make see something that is not attached properly or cross members loose or missing, these are all issues. You may see safety issues or other problems.

Why would Vern do this? Because we need to start documenting towers that are unsafe. Many climbers can refuse to climb a tower but the problem may be that they will find another crew to climb it the next day. Many climbers will climb anything where as other climbers may see problems on the tower.

If you refuse to climb, here is your chance to document the tower and why you won’t climb. This is where you, the climber can report problems towers. This is where you can raise your voice to make tower owners aware of issues. Remember, tower companies that own towers may or may not visit their tower regularly. Things get overlooked and lost and forgotten. Well when Vern’s database gets built we can have a reference to look at.

What do you need to do? You need to provide all the information possible. This of what a site list would have on it. You need to provide the details, coordinates, address, type of tower, owner if you know it, and why it is unsafe. If you say that it is overloaded, prove it by referencing the structural or other documentation. If it is not safe, be specific and say why it is unsafe or where on the tower it has issues. If there is a security issue then explain what you mean by that. Be specific in the issue and the location and the site ID if you have it. This way the tower owner can be notified. Maybe they will correct it or maybe not. Perhaps the next crew will not identify the problem or ignore it.

The database should be enough to let all climbers know that where the problem towers are. It will also be a great way to leave a trail in case there is an injury on that tower and it was identified by someone else earlier.

Vern has a Facebook page which shows the link, FACEBOOK/Unsafe Towers, in case it is easier to go there first.

So what would you do with this database? Will you refer to it from time to time? Do you think the tower owners will be held responsible for tower issues? Do you think that it is time we document tower issues in an organized manner. We need to help out any way we can. I think that when you are in the field you may be able to prevent accidents by sharing information. This is your opportunity. This is your chance to save others from a problem you identified.

Let me know, do you think this is a good idea? Do you think you will participate? Let me know. Maybe you just don’t care. Maybe you will climb anything. Maybe you think that if you don’t do it someone else will. Chances are you are correct. Once again, the industry just can’t stand together. Don’t you think it’s time that the climbers start to work together to make the industry a better industry? The FCC and the DOL are beginning to recognize the problems and importance of this industry. Why not do your part out to help out other climbers? Don’t you think it’s time we unite? This is a start.

Wouldn’t it be great if OSHA would be able to look at this to see that there are issues with this tower rather than only having to look at the mistakes the climber may have made? So many times all of the liability is put on the climber because they are the target, they are there, and it’s the only thing they can look at. The more we document and share the better off OSHA will be armed. They need help, let’s do our part. They may or may not listen but maybe we can star to use the tools at our disposal to make deployments safer.

It’s something that turf vendors may run you 100 miles to try to get you to climb a tower that is not safe, so you don’t get paid for the travel time and the turf vendor finds another sucker who will climb it. Is that a common problem? They use that all the time where they will just call someone else and you are out the money but maybe the other crew could be getting pulled into a dangerous situation because they need the money. Now you can document it and then the tower should be labeled unsafe until the tower owner makes some modifications to repair the problem.

Personal Expenses & Tower Videos

I wanted to just give you a quick note about spending. (If you don’t want to hear me talk about expenses then scroll down to the videos below!) So many new tower workers are going to start making better money than they have before. This is a job where you will get your pay and per diem. I don’t think many companies will allow workers to expense meals, they offer daily per diem, based on where you are working. Per Diem is a daily rate to cover your living expenses, normally meals. Hotels are generally expensed unless you are a contractor, then you probably pay for all of your expenses.

I know most of you are already angry that I am trying to tell you what to do with your money, I am not. If you want to spend it all every week, that’s fine. I just want to offer you some advice I got from living on the road. Also, if you are broke in 10 years because you partied every night, I don’t want to hear you whine. There is so much bitterness already, why add to it with complaining about your poor habits.

So when you start making some money take the time to think about what you are going to do with it. If you spend all of your per diem then you will have to dip into your own pocket to pay for whatever is above and beyond. I see so many workers say that they spend their per diem on beer. That’s fine but when the bill is more than your per diem then you are wasting money.

Often we need money ASAP, it is not an easy thing. It’s like losing weight, we all want to see the results immediately, but it takes time to do it right. To stay healthy we need to invest in exercise every day and eat right every day. To have money you need to be smart with your money every week. It doesn’t mean you can’t enjoy it once in a while, you just need the smart decisions to outweigh the bad ones most of the time. Buy what you want, just do it wisely.

Personally I think if you can spend less than your per diem then you will have a slight edge over most people. You may be able to put more money aside. So many people travel and get into party mode. This can become a habit and the next thing you know at the end of the month you may not have enough for the rent or mortgage.

I have been there, I was just not smart with my money. With age comes wisdom and we learn about priorities. I am only trying to offer some advice based on my mistakes. I won’t get into telling you how to build a budget. You will need to figure out what your priorities are. I only want you to think about where your money goes. If you have been doing this for 10 years and only have scars to show for it, then maybe it’s time to plan better.

When you get your paycheck, look it over and figure out how to break it out for each expense you have. Most people have car payment, mortgage or rent, maybe child support, all the expenses with living. If you live with your parents, many do, then put as much money aside for when you want to buy your house or a car. I am a fan of saving what I can.

So much money slips through your hands, on things like fast food. When you travel it’s all that available many times. Just be smart with your per diem, be smart with your paycheck. I don’t blame you for eating, but look at your spending. If you are buying crap that is a waste of money, think before you buy next time. Sometimes you may spend more on food, but if you get better food then you won’t be hungry again in an hour.

If you buy tools, buy tools that you will use. If you are buying a big tool think of the payback. When you buy a work truck, think of how it will be used and what you will be hauling and of the gas mileage. It matters.

Next time you go out to have a few drinks with your buddies think about a budget ahead of time. Don’t spend all of your money in one night. Especially if it is literally all of your money. Your friends should understand if you are honest with them.

If your company offers a 401K and they match it, I suggest you put in what they match. Why not, you will want to retire someday. Why not put away what you can. You should save as much as you can. However, don’t put it all in a retirement fund, it is smart to put some of it in savings or a CD or somewhere where you can access it in case of an emergency.

A few notes:

  • Try not to lend too much money to co-workers. That usually ends badly.
  • Try not to buy a fancy work truck if you use it for work, they get beat up quickly. Fancy versus practical, practical should always win. Trust me, when you buy fancy and something falls on it, it really hurts.
  • Spend per Diem wisely! Try not to spend more than you get in a week. The less you spend the more you save. However, you have to eat, so make sure you eat well so you have strength and energy.
  • Your boss may care for you, but the company cares about the bottom line. For all of you that think the company will take care of you, I hope they do. The reality is that if the work stops, they will not hesitate to lay you off or let you go. It’s not fair and it sucks, but that’s the way it is. Think about this when you are stashing money away. The company will ask you to be loyal and have you sign non-competes, but will they be loyal to you? Maybe, maybe not.
  • If you pay child support, this is a priority. If you don’t pay, they will track you down and take it from your paycheck. If they take it from your pay then that’s one more thing that you need to explain when getting hired.
  • Take care of yourself, you matter. Be safe on the job site but be healthy off of the job site. Only you will take care of you. Good habits really help you and your body become better with age.

Listen, bad things happen, the better prepared you are then maybe it will help you get through a rough patch. I talk to so many people who prepare and they still have a tough time. I am just trying to help you think through your life and plan for the good and the bad.

Drugs, Morons, and Steel.

I got 3 things to talk about today – drugs, morons, and steel.

Drugs:

Let’s start with drugs, yes drugs. In fact, I will make it simple, let’s talk about marijuana, pot, hemp, or the wacky weed. Whatever you want to call it, pot stays in your system for quite a while. I read this article about POT on Truth on Pot which says that detectable amounts are in the system for up to 12 hours, but could be detectable for up to 27 hours. Why am I telling you this, because if you smoke the night before and then you have a drug test the following day, guess what, you may fail. If there is an accident and they test everyone, then if there is a trial it is no longer about the accident but about the incompetent drug user on the site. In fact the blame may be put on the guy smoking. So we probably will have drug testing for all tower crews in the near future. Apparently, from the feedback I have been getting most people just can’t stop. One big party on the road. More pot articles are here and here or here. Remember that if something bad happens, there will be someone looking to lay blame, who better to blame than the pothead? Drug test should be mandatory after every incident. Random drug tests may become the standard. Get ready for the changes.

If you care about the coworkers on your site, you need to curb your habits! Even if you are on cold medicine, you need to speak up and say something. Anything that could dull your senses or could cause problems should be brought to the chief’s/boss’ attention. If you are the chief, then wake up and let your crew know. Team relies on each other to live. Lives matter, blame is too late.

Wake up pothead, I don’t care what you do on your own time, none of my business, but if a family loses anything because you’re smoking dope then we have real problems. This industry needs professionals!

Morons:

So now we come to the morons section. This is something that most of you don’t want to admit. Hey, I was a moron a few times, what set me apart was that I learned from my mistakes and I asked for help. Isn’t it great that when someone on Facebook has a legitimate question and all the people can do is rip that guy apart for being stupid! I would like to start my own forum so I can kick those guys out. We are all professionals here, grow up. Are you a skilled professional or a laborer? Which is it? There are places for both on the crew – it’s just nice to know where you stand. What can you tell me about the job you are on? I have done both, but if you are just there for the paycheck, remember that lives are on the line. Don’t be a moron!

Steel:

And now the steel section, we need to be safe on the steel. Are we looking at the big picture when it comes to safety on the tower? Do we know how safe the tower is? Did someone look at the structural? Yes, they usually do because it is an obvious hazard that can be easily, although not cheaply, looked at.

What about the tie off points? Did anyone look to see if the tower was safe to climb and if the climber had tie off points? Ever climb a monopole where the pegs are loose? I did. Ever climb a tower where the face is so huge you need to go to the top and climb down another leg to rig in safety lines? Yup, did that too. Did you ever take two people to rig a safety line to cross a face? I did that too. It’s all extra work.

What if the tower has a ladder up the middle then you need to be able to descend to the point you are working at. Usually in something like that there is very little to tie off to for your positioning lanyard much less another point to tie off your safety lanyard. You probably will need to stay attached to the rope but it’s not an ideal situation. Should the tower owner clean that up? Should they make an effort to make the towers or monopoles as safe as possible for the climbers? Yes, absolutely! Are they doing this? You tell me! Tell me in the form below because I think that when there is an accident they are often overlooked. I worked on many towers where there were so few tie off points. It really helps when they are readily available. They can be added but it costs money. Remember this article?

I think the goal should be that if there is an accident at the tower, we can unconditionally look at the guy that’s hurt and see he was at fault! That should be the goal, to clearly identify the fault, equipment failure or stupidity. Now, however, we are still not doing that. We are still guessing at what happened. Isn’t it time we start taking every excuse for an accident away? We all know that people have to work at heights, we all know how to improve some towers, and we all know that no one wants to spend the money to do it. This is one way to eliminate a problem.

We really need to work together. Remember that this is only one hazard. Keeping hydrated on the tower is a simple way to eliminate another hazard. Working as a team will eliminate more hazards. Daily inspections eliminate another hazard. Tailgate meetings and planning, eliminate more hazards. Hazard assessment – make things as safe as possible, as a team. Training will eliminate another hazard. Practice rescue techniques, keep first aid kits and trauma kits handy.
